Card Cloning down at Nedbank ATM

On 31 December 2012 I went to the Nedbank Branch in Alberton to withdraw cash at the ATM.
Whilst at the ATM, I had punched in my pin number to perform a transaction, when spotting a man right at my shoulder watching. I immediately cancelled the transaction, however, my card would NOT eject from the machine. I phoned the call centre number on the machine to cancel the card immediatly. Whilst still holding and speaking with the operator - money began deducting off my account. I suspected my card had been cloned in the machine and the reason why the card jammed and wouldn't come out.

Nedbank have totally refused to reimburse me for this loss - saying that while they acknowledge I was a victim of card swapping where card was swapped and PIN compromised. "The pin is chosen by the client of which the bank has no knowledge and on this matter the client's card and correct PIN was used to do the transactions"

How has the pin number got anything to do with the card swapping?? Why is their security more viliagiant? Are the bank not supposed to protect me?
I am out of pocket by R 5000 - surely the bank is insured for these incidents??
I am TOTALLY disgusted
