Insurance claim

Myself and my girlfriend, went to the beach and took turns swimming - but we then decided to go swimming together - we were about 100m away from out beach spot and when we return my cellphone & Tablet was gone(). In no way was I negligent because I constantly look to see where our goods where and took all the necessary precaution to safeguard our goods. The insurance company came and rejected my claim. I complained and the claim went to there legal department and my claim via legal was rejected saying: Based on the available information I am confident that were in breach of your policy conditions, specifically the clause referring to the insured's duty to prevent any losses as can be found in paragraph 12.5 on page 14 of the policy wording that states ''You are to take all reasonable steps and precautions to prevent accidents or losses - You need to take proper care of your- assets to qualify for benefits / cover" It's so easy for insurance companies to use 'the fine print' when this was a unfortunate incident which I have no control over. Why should my life be dictated by someone else() while I have fun with my family?
