THIRD PARTY CLAIM

My daughter was driving with her brand new Big Boy Scooter on 19 November 2013. She stopped at a four way stop with her indicators to the right direction. It was safe to drive, and another vehicle from the opposite direction ignored the four way stop. The vehicle indicator was also turned on right, therefore the drive was suppose to turn right in the opposite direction.By ignoring the stop sign and kept on straight, ignoring her vehicles indicator she bumped into my daughter scooter. The driver claimed that accidents happen and there is something wrong with her indicators. This resolved in a third party claim, us against Outsurance. The damage to the scooter is R 3 457-34 and Outsurance only offer us R 1 243-85. After various attempts to adjust this offer, they still refuse. Why don't they hold Mrs van der Merwe responsible to pay the difference.
