FNB- Contravention to the Consumer Protection Act

Business & Finance

How can FNB help me? Is anyone aware that FNB's T&C's are in contravention of the South African Consumer Protection Act in terms of the allowable 'cooling off period' allowed for new Smart Device bought through the bank? FNB only allows for 7 CALENDAR DAYS as opposed to 10 BUSINESS DAYS allowed for in terms of the Act. I recently applied for a Samsung Galaxy S4 package (2nd June 2013) which I expected to receive a Cell C Straight Up 100 contract offered for R299, I was informed that this was identical to the same contract offered directly with Cell C for R399.After receiving the device 2 days later and there was no communication from neither FNB nor Cell C, I then investigated to find out that this offer was only applicable to new customers and not existing. On day 8 (13th June 2013 -Reference no. 295241), I called to inform FNB of my dissatisfaction and my request to have the smart device returned cancelling the agreement, I was then told that I was 1 day too late. Today, 30th June 2013, after having been contacted by 3 different individuals arranging to collect the device, none of them have come. FNB have not even informed me of possible penalties that might apply- I will dispute this
