29-11-2012, my wife and I were driving up 2nd Avenue towards 7th Street in Melville in her BMW at midday. Due to the restaurants many patrons park on the streets, leaving just enough space for one car to get past when cars are parked on both sides of the road. We approached the stop street on 2nd Avenue carefully. As we got to the intersection a driver in a Hyundai Getz turned into 2nd Avenue. She saw us but was late in breaking and hit our front right hand side of the car. No one was injured but both cars were damaged, though driveable. The other driver is insured with Outsurance, to whom I have laid a claim. It is the opinion of Outsurance that each party was equally negligent in this collision as both parties were driving in the middle of the road. In such instances Outsurance proposed that each party bear their own costs and as such are not legally liable to pay out 3rd party claims and have no option but to reject our 3rd party claim. Lawyers are expensive and the cost of repairs would probably be less than getting a lawyer. This is disappointing and another case of miscarriage of justice. The big company wins again.
