Took payment did not Deliver since 2011

Placed order, made payment Nov 2011. He did not tell me that he was not able to deliver, nor did he try and contact me in this regard, and no attempt was made to reimburse me. After several emails and demands he finally acknowledge his default, that he would pay me back at the end of the month. This was on the 12th June 2013. He has still not done the honorable thing by returning my money for non delivery!
