Phone hasnt worked since day one for 7 months

The new phone I got when renewing my contract is a Samsung Galaxy Pocket. It has had signal and network registration issues since day one. It has been in for repairs for the same fault twice now one repair straight after the first. The phone has been used for less than 2 months (which were a nightmare) out of the 7 I have had it and now Virgin offer to replace it only if the technicians agree with the fault and it is booked in for another 3 weeks. CPA says they are meant to replace or refund if fault persists after the first repair. I told them this and they begged me to give them another chance which I did. The manager at head office now would not return my calls and due to poor service and breech of the CPA I would like to cancel my contract which they say I would have to pay the remainder of.
