IPhone 5 scratched in box

Today I went to upgrade my contract from my current iPhone 4. As a huge Apple fan and owner of an iPad, MacBook Pro and iTouch I was really excited with my new addition. However once I got home and opened the packaging I came across three scratches. Being slightly OCD about such things, I couldnt miss it.

How is it that Vodacom and Apple provide an R9000 phone that already has signs that it has been used. There is a scratch along the side, marks by the charge port and part of the silver edging has scruffs marks on. Its been only 3 hours since purchasing this phone and already Im regretting my decision as I feel Ive received a second hand product.

I did immediately take photos thankfully, but the worst is that you will now be able to deny this as my simswop has been done and Im thus forced to use this phone!
