What to do

On the 07/02/2013 Cell C phoned me to get a contract phone with them, they said it will take 7 day for the phone to be delivered I waited 11 days, i received Nokia Lumia 610 on the 21/02/2013, on the 25/02/2013 i called them to say that im not satisfied with the phone and gave them the reason why, they cant replace the phone because it has a small scratch on the bottom of the phone, they need it to be in a good state before they take it back, i was put through to this person then that person the passed 2 days, yesterday when i wanted to change my contract to a top up i was tolled that the could do it for me and that ill receive a sms or someone from Cell c will call me to say that its done, i phoned them this afternoon again and now they say i cant change my contract because the phone is scratched! i mean i dont want them to take the phone back after i scratched it i just want to change my contract to a top up, i havent even have my phone a full 7 days and now i cant do anything!!! someone please help me or give me advise on what to do, thank you
