Nokia lumia 710 contract phone

I Constance Mogano renewed my cell phone contact with Cell C telephonically and the agent recommended a nokia lumia 710 which was delivered to me on the 18/02/2013 but the phone seemed to not function properly. I called and was told to take it to my nearest Cell C store. My daughter took it on the 20/02/2013 and was told they've done the settings and it should be fine but the phone battery was always drained. On Thursday or Friday of that week I called them to report the fault and was told they would pick it up for repairs but I then stressed that the 7 day period hasn't ended so I would like to choose a different phone of my choice from the range available to me. The phone was picked up towards month end and now they're debiting my account for a phone that I don't even have and hardly used. No feedback is ever given to until I called and was told the phone has scratches but after it was always off I put back in its box with everything so I don't understand why such treatment is given to me since I've been their customer nearly or over ten years now. I called them on 17/05/2013 and was told the phone is still in the repair centre and I should receive feedback from them but nothing
