Vodacom
Sells Damaged Goods, Refuses Replacement

Telecommunications

I bought a mobile phone on 21/01/2013 from the Vodashop eastgate branch, I soon discovered that it had a fault on the screen. I returned the phone as an "Out of Box Failure" - it was in its original box, plastic covers on and showing absolutely no scratches or dents (as consistent with less than a minute of actual use). I was not contacted for a week. On visiting the shop I was told the "company (i.e.: Vodacom) policy" is not to replace phones that have any physical fault out of box. This policy is in contravention of the Consumer protection act sections 19, 20, 55 and 56 (at least). I refused to accept this and - in a tacit acceptance of their fault - they offered to instead repair the phone free of charge quickly. I agreed. I was then not contacted. I contacted the shop, I was told they were waiting for parts. Again no contact - this process has lasted 2 weeks. In total I have been out of pocket and without the phone for which I have paid for 3 weeks. I was finally given the repaired phone, only to discover scratches on the screen. They now have it. This is an outrage! Company policy cannot overrule the law of the land and this company cannot continue to act with impunity.
