HTC One 5 days old phone damaged by them

After completing two contracts from Nashua, I was offered an upgrade.
I took HTC ONE on upgrade and just after two days of use it starts giving reception/call issues.
After 5-6 hours it doesn't make or receive any calls and it needs a restart then. I took it to their head office in Midrand.
There I was given an assurance that just try it for few more days and then they will replace to new if problem still persist as it comes under "7 days replacement OBF"
I went to their store again in three days as the phone was showing same problem again and again.
It was checked by their team/technician and they accepted to send it for replacement.

After a week to my surprise they denied it and send i back quoting "physical dame on sim tray" which was not present at the time of submitting the phone.
The staff at the store also accepts that as they inspected the phone before accepting it for replacement but said they can't help it as this is the decision from Nashua.
All the accessories are still sealed including charger, earphone and usb cable as the phone was 6 days old and only used for max 30-40 hours.
Now I have to accept damaged phone & I am waiting for the phone from last three weeks.
