Oken phone not collected

I was called by cell c direct and took a contract with a samsung phone, however the phone never worked correctly. I called the call centre within 7 days to advise them and requested they collect the phone however the courier company that comes to collect it turns up without warning to my house in working hours which means I am not there. they were advised to return the next day where I would leave the phone for them to collect however have never returned. I tried to return it to the store however I am told that I can only return to cell c direct. I am now left with a phone that I cannot use which I still have to pay for? this is contravention of the the consumer act and I would appreciate you collecting the phone (by prior arrangement) and delivering a replacement phone immediately as I rely on my phone for work purposes.
