Faulty handset within 2 days returned

I upgraded my contract on 20 July 2013 at CellC Illanga in Nelspruit. On 22 July, 2 days later i tried to hand in the phone cause it was faulty. The Client Service Advisor refused to assist and said he will let the manager phone me. This never happened. i went back to the store, the guy denied that he ever spoke to me. I showed him my name and contact number written in the notebook. he just kept quiet. The manager, Moosa, booked in the handset. On 2 September, 6 weeks later, i received the handset back, fixed according to them. The next day on 3 September i took it back cause it was doing the same. Sunday 13 October i went to collect it only to find that it was a secondhand phone that was repaired with no battery.

I did try to hand in the handset within 7 days with the original packaging and the guy refused to help me. The manager said he cant help that he was never given the message to phone me so that I can book in the phone. so now whose fault is it?

All I want is a new handset cause ive done my part of the contract. Ive been a CellC customer since they've been in the Country, but this is very very poor service.
