Galaxy s4 battery bulge

A samsung galaxy s4 was taken out as a contract upgrade 2 approximately 2 months ago, however the battery has already bulged to the point where I can not put the back cover on and I do try to put in the battery the touch screen is pushed.

I read an article stating that in Germany galaxy s4's are being returned, clearly I have received a defective unit, should I not get a replacement?
