VODACOM WILL NOT REPLACE FAULTY CELL PHONE

I upgraded 3 cellphones to Blackberry 9320's on the 19th January 2013. One started giving problems in August and I took it into Vodacom Repair centre Eastgate on the 8 Sept 2013. Since then it has gone back 6 times. Last week 2 Oct I contacted the CEO's office of Vodacom and spoke to and emailed a Riael Salomon who says he speaks on behalf of the CEO (Tel: 0821944) He said that the phone would be sent to the advance repair centre and if it cannot be fixed then it will be replaced, however not with a new phone but with a repaired phone. When I sent them copies of Blackberry and Vodacom terms and conditions I found on the internet which state that the phone will be replaced if found to be faulty. Mr Salomon said that it does not specify if it is new or used! Today we were told the phone could be collected but on arrival were told that the repaired phone was not in a good condition and had been returned to head office. Vodacom have had my phone for over a month now - they have not offered me a loan phone in this time. Why should we have to settle for a 2nd hand phone, but right now we have not phone at all! How much longer will this matter take!
