Returning a malfunctioning new phone within 7 days

I signed up for a iPhone5 contract with Cell C on 26/08/2013. Within the first days, I started experiencing issues with the device:
- Unsuccessful calls and missed calls with the phone on with full signal
- Unstable data (3G) and WiFi connectivity
- Charging the phone 3 times a day while my colleague with the same phone charges hers once at night, with opened applications and notifications on such as emails, reminders, and I don't.
I reported these issues to the store on 30/08/2013 and then finally returned the device on 01/09/2013 and informed that it will take 24h. I went back to the store on 04/09/2013 to be now informed that it will take up to 7 to 21 working days. Yesterday the phone was returned to the store from repairs and they will return it to me as no malfunctioning was found.
OTHER NETWORKS ISSUE YOU WITH A NEW PHONE IF RETURNED WITH 7 DAYS BUT CELLC, now I would have to pay for a phone I did not use for half a month and keep and pay a defective phone for the next 24 months. This is the WORSE service ever and I regret signing up with Cell C as I used a iPhone4 for the last 2 years contracted with Vodacom and never had this kind of problem with the device nor the netwo
