Cant get New Blackberry Fixed without LOSING!!

In October of 2011 I bought myself a brand new Blackberry 3G Curve phone, only to have the track pad stop working properly 4 month later! Now it was still under warranty, so I took it in to Vodacom to have it looked at. only to be told that it could take up to 10 days to 2 weeks to be fixed (if it could be fixed as it was the track pad, they arent normally able to fix them.) and should it be not be fixed< I would then be given a refurbished phone, meaning second hand and someone elses problem!!! If I had wanted a second hand phone, I would have bought one in the first place!! and not have spent all that money on a new one. And secondly, when I asked if I sent my phone in to be repaired, would I atleast be given a blackberry phone to use, not lose my Bis which I had paid for, the answer was NO!!! So once more I lose money!!! This is all completely unacceptable, I am not able to be without my phone, due to work, nor am I prepared to lose lose lose!!! Its now Jan 2013 and the track pad barely works, the buttons are falling off!!! TOTALLY UNACCEPTABLE!!
