Pathetic warranty claim

Warranty claim process with MTN is pathetic. I sent back a 3 month old Blackberry 9360 as it wouldn't switch on after trying to charge it and swop the battery with another one. The warranty stated that is should be returned in the original packaging, which it was, but the phone has minor scractches from use on the back and they rejected the claim which I find highly annoying as the phone was not abused just used, what do they expect it still to be brand new after some use.
