MTN not willing to help

Let's start of by saying that we have been clients (4 accounts) of MTN for over 10 years. Never missed a payment, been loyal to the brand.
Now that I'm 17 months into my contract, had my Blackberry fixed (refurbished, not replaced) TWICE and now that it is broken for the third time, MTN just states that they are sorry for my inconvenience and according CPA laws they cannot offer me a early upgrade, they can only offer me another refurbished phone with a waiting period of 3 weeks.
Meanwhile I still need to pay for a service that I cannot use.
Thank you MTN for nothing...
