Exchanged brand new for something repaired???

I have 3 contracts with Vodacom, I decided to take out a Data contract, I went into the Cresta Store on the 13th of April 2013.
The contract was immediately approved and i left the store with the laptop and modem.
During the course of the next week, i attempted to connect to the network using the laptop and modem, the modem constantly said "Searching" but no connection.
I called the call centre who after much investigation told me that the problem is that the sim card is not active. I then asked the call centre to put me through to someone who could activate the sim card, i was then informed that i would need to call the next day because activations is already closed. This went on for the next week, eventually, I spoke to the call centre who informed me that i would need to go back to Cresta to activate.
I then went into Cresta on the 4th of May, The Vodacom staff then advised me that there was "Hardware Failure", the last sms i recieved informed, me that the device would be exchanged even though there is no activation date on system. How does Vodacom exchange a brand new modem and still debit my account for goods that i recieved that were not in working order! Job Number: 8852543
