Membership Cancellation

I joined the gym together with my son so that we can exercise together. It was more for him that I joined. He was very keen but soon after we joined his sports activities started taking more of his time since he was in WP trials. Now a few months down the line we still haven't gone to gym once and my son sustained a horrible leg injury which has put him in crunches for half the year and he has to have regular operations over the next few years. I wanted to cancel my membership today and was told I have a two year contract and have to pay 40% cancellation fees. I made it very clear to the consultant on the day I joined that I don't want to be bound to any contracts and want to be able to cancel at any time. There was no time for me to read the very fine print of the contract. This situation stinks and I'm very prepared to take this matter further with legal action if I need to. This is immorale and I'm sure illegal to trap members.
