Incredible selling second hand goods?

Yesterday I purchased a TP-link wireless 3g router. It was on the markdown table sealed in plastic shrinkwrap with the normal price attached as well as the markdown sticker. So any reasonable person would assume it is surplus/dead stock. On opening the package last night I noticed a few cosmetic scratches on the device, some residue that looked like a sticker was removed, the cable & charger was already removed from the plastic and battery was already installed.

While I have no problem buying 2nd hand/demo goods I feel I was misled into buying what appeared to be a new product at a discount, when in actual fact it was 2nd hand. There is no telling how long the device has been used or abused and how long the battery or device will last.

I feel that wrapping it in plastic and placing the normal priced sticker that Incredible acted deceptively.
While I can return it, I doubt they will replace it with a new unit and they will probably deny it being used before, so I will apper to be taking a chance. I can return and get a refund, but then I will be out of a product and IC will be out of a customer.

I hope your stores will change the way they sell used goods in the future...
