Police watch

I bought a Police watch in November last year, on the paper they say its water resistant up to 5 ATM (it means 50 meter). Water got inside and I took it back to Edgars and I was told the no watch can be waterproof because steam can go through anything. A lady also asked me if I put it into water to see if its waterproof. They sent it in to be cleaned and to see if there are any damage. I received the watch back today and when i put it on I noticed that the same fog formed on the glass again when i put it on. I also noticed that the watch has more scratches on it than when I took it in and it also shows signs of rust inside. What must I do now, its still under warantee?
