Fault in packet leads to loss of purchase

Shops, Products, Services

On Sun 26 May 2013, my daughter purchased a shirt from Traffic at Tygervalleyl. She paid using her debit card. Shortly before leaving the mall, she noticed that the plastic bag in which the store had place the garment in, was empty. I examined the plastic packet, only to notice a slit in the bottom of the bag measuring approx 10cm in length. This is an obvious fault in the bag, as the glue line does not continue over that portion of the bag. It is evident that due to the flimsy nature of the garment purchased that it, together with the till slip, slipped out of the bottom of the bag where the fault is. We have proof of purchase on our bank statement. I called the store at 4:15pm to report my complaint and claim for a replacement garment due to fault in bag. The store manager called the area manager and replied stating that we have no right to claim for this loss. I then tried to call the area manager but she did not answer any calls. On Mon the 27th I called the area manager, who again indicated we have no case to claim as a result of a faulty bag produced. Funny that when I went to the Store on Tues 28th to PURCHASE a REPLACEMENT garment that a different type of bag was used!!!
