Subject: Formal complaint and demand – Rawson Strandfontein: unauthorized disbursement, failed repairs, tenant vetting failures
Dear Rawson Head Office,
I lodge a formal complaint against Rawson Strandfontein regarding their handling of my tenant’s deposit and exit repairs at 39 Trogon Crescent, Pelikan Park, Cape Town, as well as failures in tenant vetting and management.
Key points
Deposit & repairs: Rawson withheld the tenant’s deposit (tenant: Warren Fortuin, lease June 2024-May 2024), then paid a contractor without my authorization despite my written refusal. The contractor did not complete repairs and was a no-show repeatedly.
Delays: The issue has dragged since end-May 2025; Rawson suggested Small Claims against their contractor instead of taking responsibility.
Losses: I had to finish repairs and obtain COC; the property sale was delayed, which Rawson knew as I was awaiting repairs in order to get the COC inspection.
Invoicing: I have not received proper invoices or a full reconciled statement for the deposit and disbursements.
Additional service failures (tenant screening/management)
Inadequate vetting: The tenant was not properly screened; I later experienced payment issues during the tenancy which resulted in an early lease termination. This was then not enforced correctly and the tenant vacated at the end of the actual lease.
Material non-disclosure: I was not informed the tenant lacked stable income.
Occupancy risk: I was not told the tenant intended to house multiple occupants.
Use of premises: The tenant ran a business and worked on cars from the property, contrary to what I would have approved and to typical residential use; Rawson did not prevent or rectify this.
Evidence notice: I am not attaching evidence at this stage as I await further instruction or direction to the correct party. There is a comprehensive trail of emails, WhatsApp messages, and voice notes with the Rawson Strandfontein office, agent, and maintenance officer as well as witnesses, which I will provide on request.
What I require (within 5 business days)
Immediate payment to me of the full remaining tenant damage deposit balance, and reimbursement of any amount paid to the contractor without my authorization.
A full, itemised, reconciled statement for the deposit (opening balance, interest if applicable, each deduction/disbursement with date/amount/recipient, closing balance).
Copies of all invoices/work orders/authorizations relied upon for any payment made.
A written explanation and remedial plan addressing: unauthorized payment, contractor oversight, communication failures, invoicing/statement deficiencies.
Failing satisfactory resolution, I will pursue recovery and damages and request PPRA intervention.
Further note I urgently require all of the above for my provisional taxes that need to be filed as well for the period ending 31 August 2025.
