As a 100% commission earner and someone who works out of their home office, I am eligible for certain home expense expenses. Firstly I get a notification that they have decided (they being an unqualified individual most likely) I cannot deduct these expenses, even though I have been granted them in the previous two years.

Then on objection I am told I can deduct but only what amounts to less than 5% of original expenses as apportioned. What is shocking is that still don't seem to understand that I am a 100% commission earner even though they have granted me a tax directive to this effect, nor that they are trying to apportion already apportioned expenses!!!? My tax advisor has now appealed again, making clear applicable legislation, the fact that I have a directive, letter from employer etc - I fear the same unqualified individual will once again not be moved my the facts and I will then need to move to an advanced dispute resolution which further wastes my time and costs.

Somewhere in SARS western cape sits an individual who clearly should not be in this job!
