SAMSUNG S5300 GALAXY POCKET FAULTY

I recieved a phoned on conrack 5/3/2013 and charge the phone as in structed. now i have to recharge the phone everyday and the phone is switching off and heating up. i visite an 8ta branch and the upgrade is not on the system. i feel that this phone is going to give me problems and since i am stiill in my cooling off period i want to cancell the contract on this phone with immediate effect. i want to hand the phone in at an 8ta branch and need a confamation letter from you to confirm that the contract is null and void.
