No delivery 23 weeks although complaining

I have ordered an item costing aprox $150. I have still not received the goods despite numerous emails to the seller via ebay. I need resolution before i take legal action. I have waited for 23 weeks and have been assured that the item will be resent. It is an expensive item and the seller has not responded to the last 2 emails sent to Hong Kong. Please Assist.
