Refusing to refund monies paid upfront =

In Jan 2013 my husband and I decided to move our French classes to an institution in Pretoria (60km closer to home) and immediately notified the French Academy, requesting a refund for the classes that were paid upfront in Nov 2012 (Total amount of R1, 440). They responded that it will not be a problem to refund our monies. However the following day The French Academy sent another emailing stating that they will not refund us our money because the new institution with whom we have registered is liable for the refund as they moved their classes from February to January. I have NO idea where they got this information from as this is not at all what we communicated.
I expect a refund because firstly I think it is decent practice to refund someone their money when you have NOT yet delivered the service and reasonable notice of cancellation has been provided and secondly according to LAW (Consumer Protection Action sec 17) you are not allowed to withhold monies paid upfront for a service not yet rendered.
They are still refusing to refund my money which is tantamount to! I would NOT recommend registering with this institution as this is the second time they have done this to us
