[URL Removed] will not refund unopened goods

Last week I purchased the folloing software: Microsoft FPP Office 2010 Home and Student from [URL Removed] After opening the outer clear plastic I noticed that the software does not include an email package (ie Outlook). Guess I should have done more research before to check this. As this was the main reason I purchased the software from the online store, I decided to return it and get a refund. The Disk casing has a seal on it which was completely intact. I had NEVER opened it, and the evidence to prove that was clear. After handing him the disk through his locked security gate, he turned around facing the opposite direction, opened the cover (breaking the seal) then turned back handing the disk back, and refusing to refund me as the disk cover "had been opened".
He told me that I should just sell the software on gumtree. I explained that we could easily call microsoft and they could verify whether the software has been used as it has a unique serial number. He said I'm welcome to do that, its not going to change anything. I then explained that the CPA protects me in this situation. He said you're welcome to try take me to court over R895.
