Toyota service done incorrect no I have to buy new

My Toyota Auris have the MMTransmission, which has a normal clutch but the MMT mechanism takes the changing of the gears away from the driver (almost like an automatic). Now, three services ago we took it in to a dealer in Fourways and told them about the delay and chaotic jerking of the gear changing, apparently something else was wrong, and the symptoms died down. This started again and we took it back with the next service, and told them again the clutch is faulty, they just "RESET" the software, and the symptoms were less, but arose very soon again. Now for the third service they say there is a software issue, "we can't reset it", and this is exactly outside my 3 year warranty and now I need to buy a new clutch mechanism that cost R 8000.00 Why does this sound wrong?? Why was this problem not solved the first time, now they say I had to tell them this...
