Tokai Renault sold vehicle with defective engine

Cars & Transport

On the 30 January 2013 I purchased a Renault Scenic from Renault Tokai Multifranchise via the BID4CARS website. The advert clearly stated that a"New motor fitted by Renault Tokai". But upon receipt of the motor vehicle and the invoice from the service manager which invoice was the warranty, the invoice showed that no new motor had been fitted but that the engine had been reconditioned. Upon delivery of the vehicle the engine seized and was towed to Renault Durban. The service manager Ian Ditchburn at Durban agrees that the repairs were carried out internally by a Renault agent and should carry a warranty. Tokai Multifranchise who received payment for the car and in particular Nico Brits and Mellissa Cunningham refuse to accept responsibility when Ian Ditchburn of Durban has informed them where liability. Clearly they misrepresented a material fact when they advertised the vehicle had a new motor fitted when this was not true. Had I known that the engine had been reconditioned and had no warranty I would not have purchased the vehicle. I am entited to a refund of my money as this transaction clearly falls within the ambit of the Consumer Protection Act.
