Renault - Maintenance Plan

My 2011 Renault Koleos broke down last Wednesday which it had to be towed to the nearst branch and that is Paarl. The had to be checked out as the mechanic didn't know hat the fault was but soon afterwards it was told to me the clutch had burnt out and it would cost me R10 000. I then enquired about my maintenance plan and they said they would contact them and let me know. I was then told it is not covered as the fault is from my side and not wear and tare which i feel is nonsense as i have never had this before on my 2007 Citi Golf and fel that AMH Liquid Capital is only wiling to pay for normal services and nothing more. My question is what if the brakes failed and someone died is it still driver responsibilty or will AMH Liquid Capital payout???
