Kempster Auto
Attery swopped at service

Cars & Transport

I am the owner of a 2011 Ford Fiesta 1.6 which I had purchased brand new. On 5 November 2013 l took my car to to Kempster Ford in Umgeni Road for its annual service. I have been dealing with Kempster Ford a number of years as this is my second brand new car that I purchased from them. Therefore l trusted them completely with my vehicle and had no reason to check that everything was intact after the service. On 27 December 2013 my vehicle refused to start. On opening up the bonnet I discovered that my original battery was replaced with an old one which is dated 2007. When I telephoned the manager at the above mentioned company he told me that two months had already lapsed and has refused to accept liability. The only two parties who have ever handled this vehicle is myself (owner) and Kempster Ford. So it is not possible that anybody else swopped the battery. Please advise me on this matter and what my rights are as a consumer and what the legal implications are. Yours faithfully Monica van Wyk
