Deal Cancellation

In December 2012 I saw a Black Honda Civic Hatch 2007 Model advertised on auto trader. I proceeded to contact the dealer (Xavier Motors cc, 0114361822), spoke to Alistair (salesman). I went to view the car with the aim of purchasing it the next saturday (14/12/2012). I indicated that i am interested in the car and will apply for finance through my employer in order to get a staff rate. Alistair indicated that he can only do it through Absa then they will send it to MFC for processing. On monday i filled in the MFC form then sent it them. I was a bit uncomfortable at first but as the time went on it dawned on me that they actually did not send my application to MFC (my employer) as they contacted me on the 18th Dec to ABSA wants a R5, 000.00 deposit.

I have decided to cancel the entire deal, i did not sign any contract or anything but Herman tells me he is not entitled to refund me a cent as the money i paid was a holding deposit. I want my money back, as i sent them a letter to cancell and informed them to deduct the cancellation fee (sec 82of the CPA, 68 of 2008).
