Bluebean
NCA/Prescription Act says listing max 5 years

Business & Finance

Imagine my suprise when i discovered a listing on a credit report for Blue Bean - dated 2005. There are a number of things wrong here. 1) a creditor has to notify you within a 20 day period that they intend to list you. We never heard anything. For the last eight years we have been struggling and have not applied for credit so were happily oblivious. The Prescription Act clearly says that if a creditor does not make an attempt to recover the money in a five year period that the debt prescribes. The thing is that not a lot of people are aware of this. The National Credit Act says that a creditor can list you on a credit bureau for five years. Once that five year period is up they have to remove the listing. The thing is - they don't so it pops up. In terms of both acts this listing has expired and i want it removed immediately. Blue Bean had 5 years - 1825 days to make us aware, prove the amount of the debt and come to some arrangement. Creditors think that if they leave a listing you will be so desperate to get it removed in a short period of time that you will pay and then ask the questions. In terms of the act the listing is and i want it removed - today
