Irregular & unreasonable 'money grabbing' by ABSA

During February 2013 I applied for Debt Review in terms of Section 86 of the NCA. One of my creditors, ABSA with whom I had a cheque account with an overdraft facility was duly notified of my application by the Debt Counsellor.

On the 28th of February my monthly income was deposited in my ABSA cheque account. It then appears, seeing that the cheque account was included in Debt Review, ABSA has taken my entire monthly income as a set-off against the overdraft facility.

I have mandated and instructed my Debt Counsellor, who has the required Power of Attorney, to request and demand a refund from ABSA.

Despite various communications over a period of 2 weeks by the Debt Counsellor to ABSA Debt Review Queries and ABSA Debt Review Manager, ABSA has failed to refund my income.

I am now unable to pay for essential monthly living expenses and subsequently could not pay my water & electricity account. The discontinuation of these vital services is now imminent.

Over the years I have diligently paid the relevant fees and interest every month on my cheque account without ever missing a single payment to ABSA. ABSA has therefore no bas
