Oil cooler not part of cooling system

I bought a VW CADDY 1.9Tdi Reg No. BYJ727NC in January 2012 secondhand and my creditor (Wesbank) suggest that i take a motor plan (Motorite Prestige Plan). It was around June 2012 I picked up that there was oil in the radiator tank. So I called the motor dealer in Kimberley and told him what is the problem so he arranged with a mechanic to come and fetch the vechile. The next day he phoned me and tell me that the head gasket are blowen. He was waiting for 1 week before the assessor response he got clearance from Motorite to fix the problem. The cost of repair are - R5000.00.After he fixed the car I drove it for 25km and the car just cut out, I phoned the mechanic and he came to fetch me. So the next day he let me know the oil cooler is cracked and it looks to him that was the problem from the beginning. So I told him to contact Motorite and explain the problem. Motorite said that he miss diagnosed the problem in the beginning and the oil cooler are not part of the cooling system so they are not going to pay. My question is the oil cooler part of cooling system or not? Engine repair are now R43 500.00 becaused the engine seized. Not enough space for whole story. Car still not running.
