Telkom
Consumer Protection Act

Telecommunications

I was astonished to learn of Telkoms non-replacement policy. In terms of a promotional offer on the pre-paid top-up, I was given a free cordless telephone around October 2012. The phone stopped working for whatever reason. Relying on the provisions of the Consumer Protection Act, I verily believed that the phone was still within its warranty period and that it would simply be replaced. So during the course of the morning of (Monday 4 March 2013, I called at the Musgrave Durban Customer "Care" centre (a name that belies what it was meant to be) when I was advised by an incompetent staff (a manager no less) that due to the fact that the cordless phone was on a promotion it did not carry the mandatory warranties (again contrary to what is contained in the CPA). Intrigued, I requested him to produce a single piece of documentary evidence to support his contention. Needless to say he was unable to do so. He was incapable of dealing with my query. He made not attempts to inquire what Telkom's position was on this issue. This in my view reflects badly on Telkom, its promotional products and policies relating thereto and in my view is a clear contravention of the CPA.
