Are they allowed to block E-Mail services?

Web4us signed a contract for uncapped internet and a e-mail account. All been fine untill the outgoing mail (SMTP Port 25) has been blocked. After contacting the call centre the owner replied that "spam" has been sent from the e-mail account and that they are willing to re-enstate the services with additional equipment and a additional monthly rate of more than 100% of the currant contract amount. Since that the password to the mail server also failed.

If a Contract has been signed are they allowed to block ports?
If "spam " has been sent they should be able to provide us with the mac address its been sent from?
Why do whe still keep our side clean and pay the full contract ammount but dont enjoy the service?
