NO FEEDBACK on one of their Dealers

I bought an iPhone5 Brand New sealed in the box from a Cell C dealer. I reported it faulty via email on the 3rd day and returned it physically on the 6th day to the dealer. The dealer told me THEN, that it was a CELL C network phone, and as such, it would first have to be sent in to determine whether or not, it was an out of the box failure, and then proceeded to imply and argue that the phone had been dropped. The phone does not have a single scratch or mark on it, it is not water damaged, plus I have 2 reports, one from an iStore and another from APPLE's Official Importer & Distributor, stating that it IS an OUT OF THE BOX FAILURE. I have taken the phone to CELL C but they claimed it wasn't their phone and refuse to accept it, saying I should return it to the dealer. I can no longer trust the dealer due to their insinuation, they also say that due to their agreement with CELL C, I can't get a brand new replacement?!?!?! Given the lack of response from CELL C to my emails, it looks like neither CELL nor the dealer are willing to back up what they sell?! APPLE's policy is that if you buy something new and it's faulty, it is immediately replaced with another new one?!?!
