Insurance refuse to pay out phone

My Cell phone (S4) got on Sunday the 1/12/2013 after reporting it and blocking the device I put down a claim for my phone. The next day my insurance tells me that they refuse to replace/ pay out the phone due to the fact that my Sim card was not in the phone at the time of loss due to the fact that i was using another device. Firstly I pay R159 A MONTH FOR THIS INSURANCE AND I DID NOT RECEIVE A COPY OF MY TERMS AND CONDITIONS WITH ALL OF THIS INFORMATION STATED. This is devastating considering the fact that i made sure I took the most expensive insurance to insure complete cover just in case a terrible incident like such occurred and to be told that i am not covered for a stupid reason such as my Sim card no being in the phone at time of loss is rubbish!!
