Refusing to cancel and refund contract

I was contacted from a Call center selling an upgrade to which i specifically mentioned 4 times that i dont want a second contract but only an upgrade Sept 2010. Which was confirmed by agent!
Upon first deduction I realised i am paying for a second contract - I complained and they confirmed contract was cancelled.
In this process I moved and did not receive statements.
Upon receit of first electronic statement June 2012 I noticed that the contract was still deducting - I immediately complained, promise after promise was made until i started with Legal action.
During our mediation process Altech confirmed that they only have to make payment of the refund they can not find any application form or Voice Recording of me taking a contract with them.
They now refuse te refund me and every month the debit keeps on deducting. They owe me R10 813 and counting! This line / nr has not been used for one call, sms, internet or any other form of cellular service. Altech Autopage Cellular has been instructed on numerous occassions that they must stop deducting, but they want me to cancel - I cant cancel the contract because i did not take it out.

I am now persuing litigation steps!
