Damaged cellphone

Last year (September) I've bought a Contract Nokia 710 Lumia Phone. But I've take it back to the shop 3 times because its not working. I can't hear when i'm receiving a call. Its really useless and upsetting me. I'm paying it each an every month but I can not use it. I believe that I've bought a damaged phone without noticing.
My question is"why they don't give me an undamaged cellphone". This is so unfair to me. I am so disappointed with MTN/ Nokia.
