Contract I-Pad in repairs for almost 3 weeks

I have upgraded my account with MTN and received a 32Gb IPad. After about 8 days of use I noticed the device switching on and off by itself. I took it back to MTN Centurion Mall and was assisted by Melissa. The IPad was booked in and sent to the repair shop. I have been given the run around by the Repairs division. Melissa received a quote of over R3000 to repair physical damage on the device. The device was perfect when I handed it in, and it was handed in for software issues - NOT hardware. I refuse to pay, and I want an undamaged IPad back. Melissa has tried her best, but to no avail. I am paying for a data service I do not use currently. Melissa did find all the supporting documentation which proves that the device was undamaged, and that I only received it 10 days prior to the software issues.
