Non repair/replacement of damaged goods

Shops, Products, Services

I purchased a TV Samsung 40" FHD LED on 1 December 2012 from Makro Rossburgh Durban. I was working in Johannesburg & did not open the TV packaging until end of January 2013 when I returned back from Johannesburg. On opening the box, I saw two round rings on the lower bottom corner of screen, plugged the TV in, and saw the screen was damaged. On Saturday 02 February 2013 I took the TV back to Makro Rossburgh. The TV was sent away for evaluation. About six weeks later I was contacted by Makro, to be informed it would cost me R 3300.30 to repair. I informed the sales lady that I do not accept this as I paid R 4999.00 for the TV, and it had not been used. I also purchased an extended warrantee to cover the screen as per the sales lady suggested to cover the screen in case anything should go wrong with it. Makro Rossburgh Brenda suggested to refund the extended warrantee but later she advised me that Makro was not prepared to refund the warrantee. I wrote to the Ombudsman asking advise and they have now referred me to take the matter up with National Consumer Commission referring to Section 29 Section 55 and section 56 of the consumer credit act. No reply from NCC. Need advise
