BAD SERVICE AND BAD ATTITUDE

I bought a Blackberry 9360 at the shop on 17 September 2013 and now last week Saturday i saw that the phones screen is having a black scratch on the inside and it looks like a blob of the ink doesn't correspond when working on it. I phoned around and asked what is my rights and o they told me that the shop is liable for the phone the first 6 months if anything goes wrong i can insist on a new phone as i dont want the phone send in for repairs because you lose money when people see the phone was allready opened when trying to sell it. i took it to a friend of mine that told me its a factory fault because it didnt fall or anything then there should have been a chip on the screen and deep scratches. i went to the shop today this morning at 09:33 am and when i told the responsible guy that i insist on a replacement or a refund he told me with a bad attitude that i have to send the phone in for repairs he can not replace the phone after i told him that i dont want them to open up the phone as i lost R 1200 on a phone that was opened and i tried to sell them. i am very disapointed when i ask the guy for the original papers he say im making his life difficult. please do something.
