Defy Oven not hot enough to bake

I have bought a Defy 60cm 3 pcs on the 10/11/2012, i have tried to bake with the oven and find out that the top element is not hot enough to bake, i have contacted Game Westgate and spoke to Ruben, he has sent the Defy technicians twice and they confirmed that is the way the element has been made and it cannot heat more than that. The reason why i bought the oven was to be able to bake. I am so disappointed about this product. I have asked Ruben to change the oven for me even if I pay an extra as I need the working oven, but he refused.
