Refund on advance payment for Clearance Certificat

I had to pay 3 months in advance in order to get a Clearance Certificate for the sale of my house. I was told that as soon as Transfer goes through the money will be paid back into my account and the new owner will be billed. Transfer took place on 22 August 2012 and I am still waiting for my refund. Council tells me my money is being kept towards an account that is NOT in my name, but in my ex-husband's name only. I have sent through all necessary papers to prove the Divorce as well as the agreement which was approved by the High Court that all proceeds from this refund should be paid back to me, as I had paid for these in advance. I am at my wits end as I am not getting through to the Council although I have furnished all this about 3 times. It is now nearly a year since I paid this amount and I should be earning interest on it.
